By accessing and using Ketpy's website or services, you accept and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services. Ketpy reserves the right to update these terms at any time without prior notice.
Ketpy provides software development, DevOps, cloud computing, AI/ML, mobile app development and related technology services. The scope, timeline, and cost of services are defined in individual project agreements or statements of work (SOW) agreed upon between Ketpy and the client.
All content on this website including text, graphics, logos, images and software is the property of Ketpy or its content suppliers and is protected by applicable intellectual property laws. Work product created for clients under a service agreement becomes the client's property upon full payment as specified in the project contract.
A 50% advance payment is required to commence any project. Subsequent payments are milestone-based as outlined in the project agreement. All payments are non-refundable unless specified otherwise in the refund policy. Ketpy reserves the right to suspend or terminate services for overdue payments.
To kickstart any project — whether it is a new website, mobile application, software product, cloud deployment, DevOps engagement, or any other engineering work commissioned to Ketpy — the client is required to deposit a minimum of 40% of the total agreed project value before any Ketpy engineer is assigned or any discovery, design, or development activity begins. This deposit is strictly non-refundable and secures the reservation of engineering time, project-management bandwidth and third-party tooling on behalf of the client. Prior to production deployment, source-code handover, DNS switch, mobile-app-store submission, or any other form of go-live, the client must have cleared every remaining rupee (or equivalent foreign currency) of the invoiced amount — including all approved change-requests, third-party pass-throughs, applicable taxes and any late-payment interest. Ketpy expressly reserves the right to withhold deployment, code delivery, credential transfer and access to production environments until the invoice ledger reflects a zero balance-due. Even a single outstanding penny — however immaterial it may appear — is sufficient grounds for Ketpy to pause or postpone the live release. The client acknowledges that any timeline slippage arising from such non-payment is entirely at the client's cost, and Ketpy shall not be liable for any consequential business impact of the delayed go-live.
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. Ketpy will not disclose client data or project details to third parties without explicit written consent, except as required by law or to provide the contracted services.
Ketpy warrants that services will be performed with professional care and skill. We do not warrant that our services will be uninterrupted, error-free, or completely secure. Certain business outcomes cannot be guaranteed as they depend on factors beyond our control.
To the maximum extent permitted by law, Ketpy's total liability for any claims arising from the use of our services shall not exceed the amount paid by the client in the three months preceding the claim. We are not liable for indirect, incidental or consequential damages.
If a client cancels a project after commencement, the advance payment is non-refundable. Any work completed up to the cancellation date will be billed at the agreed hourly or milestone rate. Ketpy may terminate a project engagement with 14 days notice if client obligations are not met.
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India. International clients may request arbitration under ICC rules.
